DA to study leak of ex-cop’s files
Candidate’s disciplinary record secretly released

    Schenectady County District Attorney Robert Carney said he will review whether a crime was committed with the release of retired city police detective Joe Lazzari’s disciplinary file during his unsuccessful election campaign for sheriff.
    Carney said he met with Lazzari Wednesday and agreed to review the matter and offer a legal opinion.
“I don’t know if a criminal action occurred. The act is the disclosure of the file. It could give him a civil cause of action,” Carney said.
    Copies of Lazzari’s disciplinary file were released a n o n y m o u s l y to local media, including The Daily Gazette. Columnist Carl Strock wrote a column about the information.
    The file covers the years 1993 to 2002. Lazzari retired as a detective from the Schenectady Police Department in 2004 after 26 years.
    Shortly after Strock’s column appeared, the Schenectady County Democratic Committee mailed a flier containing Lazzari’s disciplinary information to voters during the final week of his campaign against Dominic Dagostino.
    Lazzari was running on the Independence and Republican lines. Dagostino ran on the Conservative, Democratic and Working Families lines. Dagostino won by more than 1,000 votes.
    Lazzari said he suspects the leadership of the county Democratic Committee and that of the Schenectady Police Benevolent Association, the union representing city police officers, were responsible for releasing his fi le and sending out the mailer.
    The Democrats’ flier contained far more detail about Lazzari’s disciplinary record than was contained in Strock’s column, suggesting they had access to it. “There you go,” Lazzari said.
    Lazzari called the leadership of both organizations decrepit and lacking in integrity, moral fiber and honor for sending out the information under a veil of secrecy.
    “To try to tarnish and discredit my 26 years of serving my city is despicable,” Lazzari said. “They will not come forward and say who did it because they are cowards, so we will have to investigate it,” he said.

To ensure impartiality, eliminate bias whether intended or unintended, and avoid the appearance of complicity or a conflict of interest in the review, I would contend that DA Carney should refer the matter to the FBI to investigate and to determine if a crime was committed.  

Recall that Carney's name appeared together with that of Dagastino (Lazzari's opponent) on campaign lawn signs.  Further, both Carney and Dagastino were endorsed by the Schenectady County Democratic Committee and the Schenectady County Conservative party, the committee of which includes the Schenectady Police Benevolent Association President.  In the Daily Gazette news article, these two organizations are identified by Lazzari as being suspected of being responsible for the release of his disciplinary file.

If DA Carney wants to eliminate any semblance of a conflict of interest in the public's view, he should recuse himself and that of his staff from conducting the investigation.  Otherwise, the findings may never be fully accepted by the public.

According to the FBI web site,

"The FBI is the lead agency for investigating violations of federal civil rights laws."

So, if Van Norden is stating that police personnel files are protected by the Civil Rights Law, why was the FBI not engaged, rather than the County District Attorney's office, in this investigation re: the unauthorized disclosure of information contained in personnel files?

I'll admit that I'm confused by Mr. Van Norden's exception that "the law does not prohibit an independent party from distributing the information".  How would an "independent party" obtain these files if their disclosure was not authorized by the parties responsible for protecting them?

As I recall there was something similar done during the Conservative Party Committee Elections last year to discredit an opponent by releasing alleged protected and private information in an attempt to discredit the individual.  That mailer was sent to rank and file enrolled Conservatives from an anonymous source.

Seems to be the modus operandi of some engaged in Schenectady County politics.  Would be nice if elections were about issues and qualifications, rather than personal destruction.

Brad-

You seem like a decent guy but the campaign is over.  LET IT GO!  Your day in the sun has passed this time around and live to see another day.  Don't follow the "scorch the earth" mentality that has permeated the Rotterdam Republicans.  It's uncouth, vindictive and just plain WRONG!  Dredging up the past sometimes is exactly why that particular candidate(s) sometimes fail.  We all have made a mistake or two in our lifetime and we will probably make a few more down the road.  Follow your heart, not somebody else's "bitter" pill.  JMHO

PS I am a survivor of many campaigns throughout NYS where they have had a direct impact on my life and my family's life.  Digging for dirt ends up as tomorrow's mud.  Keep your chin up and FIND NEW POLITICAL FRIENDS to hang out with.  The one's you have now hurt you more than you care to admit or even know.   IMHO

A special investigation is called for in the Lazzari case.   What happened is totally illegal and I am surprised that Carney has not come out and made that statement.  Where's Mary on this.?  Absent again??  You should be calling for a NEW election.  Where's the moral outrage?  I just called Democratic HQ to voice my opinion.  Get on this Mary--you have reason to come out of the bunker.
