I CAN NOT BELIEVE, that the gazette is even making such an issue out of 2 small, little bitty websites who use these articles for discussion purposes only! No one is making money off these things for God's sake.

If you notice, the attorney cites a case involving the FREE REPUBLIC. I read the entire case on-line. What a major difference in sites. The FREE REPUBLIC, back in 2000, had a member list of 20,000 with 1 MILLION hits per month. And also, the FREE REPUBLIC had private advertisements on their site.

It's bad PR for a little community newspaper.

we have the national public radio over there and it would be better if we could control the crazies by having the nationbal public paper for each town that way we wouldnt have the hate - mongers and that there like we have on the 8 10 radio station and that. The gazette is still repub leaning and unfair to the demos in a lot of ways but better then the WGY crowd. But I do think nationalizing it over here makes the sense

If I thought that the issue was genuinely about copyright infringement and that the Daily Gazette was being adversely impacted by posting their articles to a web forum with only several dozen participants, I would have a different position on the issue.

Contrary to your assessment, I believe that the objections of Judy Patrick and the Daily Gazette are politically motivated, likely initiated by a seated politician in city or county government, and a blatant attempt to silence political opponents, particularly Pat Zollinger who has recently taken issue with the Mayor's raise that was included in the city budget and the conduct of elected representatives at the City Council meetings.  If that makes me a conspiracy theorist in your mind, so be it.

Those at the Gazette will do what they must.  We, the consumers in the community, will do what we believe is required, including withdrawing our financial support for biased journalism.

After reading all these posts, I believe the reason is profit motivated.  I have considered cancelling my subscription in the past since I could obtain the articles of interest on this site.  If everyone thinks the same thing the paper will no longer be available in any form.  Just my thoughts on the matter.

Because I respect, though don't always share, your opinions on the issues that we discuss in these forums, I decided to detach my concerns about about the suppression of our guaranteed freedom of expression from that of copyright infringement.  As I am not an Attorney nor have I studied law, I cannot assess if a copyright infringement has occurred as I don't know the criteria.  I presume that the reproduction of copyrighted materials in part or in their entirety is one factor in determining if a violation has occurred.  Are there other factors that are considered?  In particular, must the reproduction of the copyrighted materials be for the purposed of financial or personal gain?  Must the use of the materials result in a verifiable loss of revenue, reputation, etc. of the creator?  If prior permission, either explicit or implied, was granted for the use and reproduction of the materials can it be rescinded?  If so, can the rescission require that reproduced materials be removed from venues in which they appear/ed?

I am curious also about if selective enforcement is considered in a court of law in deciding these cases.  I suspect that the articles that have been published by the Daily Gazette appear on other web sites.  Additionally, I believe that the public libraries place the articles on microfiche.  Is the latter a copyright violation?

Lastly, I am wondering about your position re: the use of copyrighted materials by Mark Blanchfield in his campaign advertising.  Granted that his campaign claimed to have obtained the video from You Tube, which is public access.  However, the materials were copyrighted by its creator.  The video may have been posted to You Tube by the Amedore campaign with the explicit permission of the owner.  Lastly, unlike the use of the Daily Gazette articles in the forums, the Blanchfield campaign edited/ modified the original work to substantially change its meaning and impact.  Certainly Mr. Blanchfield, an Attorney should understand copyright law.

As for Rene's belief that the actions of the Daily Gazette are profit drive, I believe that if the Publisher is concerned about the potential loss of revenue resulting from perhaps a few dozen people not purchasing a print copy or paying for online access, then their business may be in worse financial shape than reported and there are bigger issues to contend with than the reproduction of some of the content to a few web forums visited by only a few dozen individuals.

When I still HAD my subscription, I read the paper and then came to this site hoping one of the articles I was interested in was here, cause I'd have something to say about it. I also found that there were many more articles in the hard copy of the gazette than what was on here or even the Schenectady's site. There were very few articles here in compared to the hard copy of the gazette and they were usually of interest regarding the immediate county.

If anyone reads the entire gazette, they would see that there are very few articles regarding Schenectady County. The majority of the gazette is about other areas outside the county.

So, for me, these boards did not stop me from buying the hard copy of the newspaper.

I would suggest that it's time for the Administrators of this site and the Schenectady forum to restrict access to only registered users.  The Administrators then have the option to deny access to those associated with the Daily Gazette or charging them for access.  Further, if the forum Administrators copyright the info that is posted to these sites, they can selectively prosecute the Daily Gazette reporters who obtain their leads and quotes from these sources.

Without access to these sites, the Daily Gazette reporters will not have their "finger on the pulse" of the county residents.  In such case, the publication will become even more irrelevant of a voice of/in the community than it is presently.


It would only be irrelevent to those that actually attempt to make themselves less ignorant......the rest of the folks are standing
in the "will vote for food/money" line......JMHO

What is copyright infringement when the article is posted as to where it came from, the date and the author.....no different than a research paper...

this site has a disclaimer at the opening and it is all for discussion.....I dont purchase the paper, I read the copy at work, long before I hit this forum

No one infringes on my job for the money....I pass pills and clean up crap for a living taking care of folks who cant take care of themselves no profit
per say doing that......but, I'm good at what I do......

If the gazette is afraid of losing profits and interest in their jobs/product then maybe they are not doing it well enough....I'll trade places with them
they can do my job and I will do theirs.....although we are always short staffed and it's real hard to find exceptional workers sometimes.....

God forbid they press on to educate the ignorant.......People's Press is what they need to return too....

I, personally, have stopped purchasing the Daily Gazette.  Instead, I have found a new place to go each morning for a fresh, soft bagel and a good cup of non-fair-trade, non-organic coffee.  I go over to Bagels and Bakes on Curry Road, right next door to the eyesore Capitol Plaza.  They have the Gazette and Times Union right there for you to purchase a copy, along with some GREAT service.  Let's put it this way, the second day I walked into the store, the young woman working behind the counter already knew what I wanted.  She asked if I wanted the same thing and went about making it while I got to make up my choice of blends of coffee (more than are offered at DD's or Mobil, not sure about the # against Cumbys) and get out of there in mere moments and on my way to work.

I suggest you stop in and give them a shot.
