The new measure, signed into law by Gov. David Paterson, requires employers with 50 or more employees to give workers at least 90 days’ notice in advance of a layoff.
The federal WARN Act, by comparison, sets the threshold for notification at 100 employees, with advance notice required 60 days before the layoff.
The new regulations were announced at a press conference this morning at the former Tech Valley Printing plant in Watervliet, which shut down abruptly in February, notifying the state Labor Department only after the fact that it had laid off 50 employees. In fact, according to the Labor Department, 150 employees lost their jobs.
“The actions against the workers of Tech Valley Printing are a textbook example of what not to do,” said Labor Commissioner M. Patricia Smith. “Had the Labor Department and local officials been provided sufficient notice by the company, we could have intervened on behalf of the workers, offered them services while they were still employed, and even helped them land new jobs…”
The new measure sets penalties of up to $500 per day, and gives the labor commissioner the authority to order relief, including back pay and medical benefits, for employees who didn’t receive the required notice.

State toughens plant closing, layoff notification ALBANY — New York Labor Commissioner M. Patricia Smith says many workers around the state will be guaranteed at least three months notice before mass layoffs. The State Worker Adjustment and Retraining Notification Act requires private employers with 50 or more workers to notify employees and the labor department at least 90 days before a plant closing or layoff. Businesses that don’t will be subject to penalties up to $500 daily for each violation. Smith says the law also gives her authority to order back wages and unpaid medical benefits for affected employees. The state law is more strict than the federal version, which requires 60 days notice at companies with 100 or more employees. Smith says the federal law also lacks an enforcement system.

The legislatures didn't think that far ahead Bumble so they didn't realize that the companies could just fire all their employees and leave. Welcome to the Socialist Republic of NYS, be happy in your work. |
