No its the will of a few, even if it was the majority the government has no power under the constitution to force people to buy a service/product. This country is not a pure democracy no matter how much you wish it was. Obamacare is a disaster waiting to happen and is destined to fail, most companies will rather pay the fine than to pay for healthcare to their employees, most citizens will boycott it once they realize their taxes were raised because they couldn't afford insurance. People are already struggling to make ends meet as it is, with gas already above $4.00 today and food prices increasing this will crush people financially.


The fine for not offering health care will be used to buy health care from private insurers in a Govt supervised
pool of insurers.
Either way... the employer pays for it's employees health care.

No it won't because what isn't talked about is the employers right to change the original contract because obamacare voids all original contracts between the employee and the employer. Now the employer can and will make up the funds by sticking it to his employees,they can cut hours, salaries, overtime pay etc just watch this will happen and it will cause a sh*t storm.

There are a lot of Conservatives that stand to make a lot of money if HCR is stalled once again.  

The rest of the developed world has similar systems that work well for their citizens... just the USA is alone with
no health care.

I'm just telling you what is going to happen, with original contracts void who do you think is going to take it up the a$$ the employee or the employer. The hard working Americans who are just getting by are going to have to tighten up their belts another notch, the only option they have is which one gets to screw you the government or your job.

Doctor Panels Recommend Fewer Tests for Patients

In a move likely to alter treatment standards in hospitals and doctors’ offices nationwide, a group of nine medical specialty boards plans to recommend on Wednesday that doctors perform 45 common tests and procedures less often, and to urge patients to question these services if they are offered. Eight other specialty boards are preparing to follow suit with additional lists of procedures their members should perform far less often.

The recommendations represent an unusually frank acknowledgment by physicians that many profitable tests and procedures are performed unnecessarily and may harm patients. By some estimates, unnecessary treatment constitutes one-third of medical spending in the United States.

“Overuse is one of the most serious crises in American medicine,” said Dr. Lawrence Smith, physician-in-chief at North Shore-LIJ Health System and dean of the Hofstra North Shore-LIJ School of Medicine, who was not involved in the initiative. “Many people have thought that the organizations most resistant to this idea would be the specialty organizations, so this is a very powerful message.”

Many previous attempts to rein in unnecessary care have faltered, but guidance coming from respected physician groups is likely to exert more influence than directives from other quarters. But their change of heart also reflects recent changes in the health care marketplace.

Insurers and other payers are seeking to shift more of their financial pain to providers like hospitals and physician practices, and efforts are being made to reduce financial incentives for doctors to run more tests.

The specialty groups are announcing the educational initiative called Choosing Wisely, directed at both patients and physicians, under the auspices of the American Board of Internal Medicine and in partnership with Consumer Reports.

The list of tests and procedures they advise against includes EKGs done routinely during a physical, even when there is no sign of heart trouble, M.R.I.’s ordered whenever a patient complains of back pain, and antibiotics prescribed for mild sinusitis — all quite common.

The American College of Cardiology is urging heart specialists not to perform routine stress cardiac imaging in asymptomatic patients, and the American College of Radiology is telling radiologists not to run imaging scans on patients suffering from simple headaches. The American Gastroenterological Association is urging its physicians to prescribe the lowest doses of medication needed to control acid reflux disease.

Even oncologists are being urged to cut back on scans for patients with early stage breast and prostate cancers that are not likely to spread, and kidney disease doctors are urged not to start chronic dialysis before having a serious discussion with the patient and family.                                           http://www.nytimes.com/2012/04.....p;

The hard working American is the group who will benefit most from HCR.  If you think that food and gas
are expensive... neither match the cost increases in Health Care UNDER THE PRESENT SYSTEM.
To say "IT'S NOT GONNA WORK" doesn't add much to the debate... it works in every other developed country
in the world... why wouldn't it work here???
Health care in America is great if you're a Rich Conservative... that's why they are trying to limit health care
for everyone else.

I do think health care reform is needed, but the individual mandate in the present law is IMHO, unconstitutional and should be struck down. The argument about "everyone" eventually needing health care is false. You can choose not to participate in the system... which means you can choose to get sick and die from something that is curable.
As our Constitution is written, its something we are either going to have to live with, or amend the constitution.
If the individual mandate holds, what is next? Penalizing people that eat fatty foods, participate in "dangerous activities", or that are overweight? Being overweight is something that sliding too.. It used to be based on the BMI, now  the medical  field is looking at the amount the fat on people. Which would put people, who do not physically appear to be overweight, as such.

If the individual mandate is struck down, it will be by a 5-4 majority if ALL of the legislation is struck down, or by a 6-3 (with Sotomayor in the majority) if the rest of the law is allowed to stand,

Either way,its back to the drawing board for the mandate.

The mandate will be out of the law and it should go back to Congress to implement the better parts of the bill, the parts everyone agrees that we need.If the mandate stands then this country will have started down the road to becoming a Socialist country.

I'm not arguing that point, but the individual mandate was a poor choice to get everyone in the system because the constitution does not allow it.
Even if the mandate is upheld, you still have the illegal immigrant issue. These People who are not forced to buy into the system, but will still get care at Emergency rooms.

House Minority Leader Nancy Pelosi  said that when the health care bill passed, President Obama told her
that he was happier than when he was elected President.

Pelosi also predicted the Supreme Court would ultimately uphold the law on a 6-3 vote.
