And I believe that if they pass the proposed sex offender law here, it will be overturned as well. The civil rights groups have already made it clear that they are ready to fight it if passed.

Boy, can you tell where my mind has been lately. I think I'm going to have to re-read this message board and bring myself back up to date. Now they did pass it, but it only applies to "new" registered sex offenders right? And it doesn't apply to the already exisiting offenders where they reside now, right?

I guess I've been out of the loop longer than I thought.

Stress is an awful thing, and you have been under a ton of it with your mom....
They repealed the law requiring the existing sex offenders to move by Oct. 1.  Any new sex offender will be required to live outside the 2,000 foot range of schools, parks, etc.

Man pleads guilty
to having child
porn material

   BALLSTON SPA — A Clifton Park man accused of possessing child pornography has pleaded guilty in Saratoga County Court.
   Karl K. Westphal, 31, 62 Apple Tree Lane, pleaded guilty before Judge Jerry Scarano this week to one count of possessing an obscene sexual performance by a child, a class E felony.
   The crime is punishable by a maximum of one to four years in prison. Westphal will be sentenced Jan. 23.
   Westphal was arrested by state police in Clifton Park in October, and accused of being in possession of videos and photographs on his personal computer that police said depicted children under the age of 16 engaged in sexual activities.
   Authorities said they were alerted to Westphal’s activities when an unidentified person became aware that the pornography was on his computer.

Sex offenders sue over residency laws  
  
ALBANY - A group of convicted offenders have filed a lawsuit against the counties they live in.

The attorney who represents the sex offenders, Terry Kindlon, says they're suing over county laws that state where they can and can't live. Kindlon says laws that say how far a sex offender has to live from schools and day care centers is unconstitutional. He says it's doesn't help and that if anything it's causing more problems.

Five sex offenders are suing the counties they live in -- one in Albany County, three in Rensselaer County and one in Washington County.

Kindlon won't reveal his clents' names, but says the majority are Level 3 sex offenders. He says they've all had trouble getting their lives back on track since these laws have been put in place.

Kindlon says his client in Albany County is a Level 3 offender who's now elderly and disabled.

"He's diabetic and he needs some place to keep his insulin and it turned out under the Albany County law about the only place he'd be able to live is in a motel out on Central Avenue in the town of Colonie," Kindlon said.

Kindlon's client in Washington County has a family and recently bought a home.

"And after he moved in he discovered there was a day care center with no sign within 900 feet of his home he told them and their response was, 'Sorry, you'll have to move,'" he said.

"It's like the Sheriff of Nottingham banishing you from the kingdom. You're being driven out," Kindlon added.

Kindlon argues that there's already state law that regulates where sex offenders can live. The county laws, he says, conflict with the state law and make it more difficult for sex offenders to live a normal life.

"Ultimately the people we're trying to protect, the children, aren't protected because what you do is you drive the sex offenders underground," Kindlon said.

The outcome of this lawsuit will affect the Schenectady sex offender law as well and I'll bet they'll have to change it again or repeal it.

Actually in the old testament folks were sent to 'some place else' with a 'warden' in charge....when that warden died their sentence was over......we call it prison now but with judges making the call....I guess it was too dangerous for the warden, everyone would always be looking to kill him(I dont think there were shes')....now criminals just go for the judges and lawyers (which end up being the one in the same--why?)

Rene, and you are surprised by this? The dictatorship holds all of the cards. They will drag this out forever. And you just watch and see, this will end up being just like Spitzers driving license fiasco. The state may step in and make some changes to the law which will be the legislature's saving grace!

But a question for you Rene....have you tried contacting them asking for the next scheduled date for a meeting? And if so, did you get a respond?

No I'm not at all surprised.  No I have not tried contacting them, I don't feel the need to beg them to do their job.  The terms of the agreement were simple.  The leg took control and established the committee, we were to address the issues enumerated in the amendment and come back with recommendations within 90 days of August 24.

All they are doing is pressuring the State to be more heavy handed with the state law.....the state must deal or look like idiots....and the fact that there are lawsuits coming up, the state will have to deal and get the egg off their faces.........The public demands it.....

This whole conversation will make a nice juicey tid-bit (AGAIN) for the politicians at election time since they have nothing else up their sleeves and want to keep us chasing our tails over something that really cant be controlled(the sexual impulses of a depraved society), all the while collecting taxes/revenue from all the adult 'bookstores'(tongue in cheek) and 'gentlemans' (tongue in cheek) clubs etc......
