#The Rotterdam Town Board was expected to award Columbia Development Companies’ bid to purchase the ailing plaza for $1.23 million and redevelop the 12-acre site, but a resolution did not surface at its Wednesday, Sept. 12, meeting. Columbia’s bid was nearly triple that submitted by the only other bidder, Forum Industries, Inc.

#However, it turns out Columbia will not be able to fulfill its wish to purchase the adjacent Palma Lumber property, because The Golub Corporation recently bought it, according to Town Supervisor Harry Buffardi. That development could jeopardize the entire process.

#“The landscape has been changed,” Buffardi said. “This complicates the issues and we certainly have to entertain the bids in an appropriate way.”

#Councilman Robert Godlewski asked Buffardi if the board would vote to award the bid at the next meeting on Wednesday, Sept. 26, which spurred Buffardi to explain the problem.

#“To rush into this in a hasty manner and have bids withdrawn or bids rejected, we have to proceed in a cautious manner,” Buffardi said. “It is my intention to bring it forth at the next board meeting.”

#The town acquired the plaza property from The Golub Corporation, but it holds a deed restriction not allowing anything competing with Price Chopper to be developed at the site. A competing business would be allowed on the adjacent Palma Lumber property just purchased by Golub, but Columbia hasn’t disclosed whatever plans it had for that area.

#Calls requesting comment from The Golub Corporation and Columbia were not returned.

#Columbia has worked with one of Price Chopper’s new local competitors. Thank you Golub Corp for keeping that sh!tyard eyesore as part of the Rotterdam landscape for the past 20+ years.
It's one of few reasons you'll never see me in a Price Chopper.

They're shrewd marketing people - cut off the competition by acquiring semi-adjoining property.  

I wonder if Rotterdam can sell that property to someone else, how long the deed restriction is in force.

Well it appears evident now why Price Chopper wanted Palma land...and the vegetable isue was just a justification for use of the property.

So, with that said, whoever prepared the bid pkg should be retrained.  If what I'm reading is correct, Columbia can back out of the deal because their goal was to purchase the center in conjuntion with purchase of Palma. Bid should have been written as legal and binding, without restrictions. If it is done that way, Columbia must honor their bid, even though Palma is sold. Let them pay the amount bid and sell it off to someone else if they want, but they should be legally bound, if it was written correctly.

Don't blame Price Chopper!!!!! The town of rotterdam AGREED to Price Chopper's terms when they aquired the land.
It appears that the town of rotterdam and the developers didn't do their homework.

Many years ago, I heard the restriction was for 99 years.....i could be wrong here.

Ok, 99 years makes sense - but is it still in force if it's sold to another party?  

Maybe a real estate person would be able to answer, this is beyond my pay grade.

Terms of acquistion by the Town would follow to any future purchase, so yes it applies. That's why Columbia wanted Palma. It appears to me what they wanted to do was circumvent the limitation by putting competing business on the Palma property with other overflow businesses on the plaza part and plaza part also being access.  How ironic that PC happened to buy Palma now....doesn't that seem a little shady?  Gotta asmit, PC is shrewd, they know what they're doing.

It can be foiled for since the town of rotterdam (all rotterdamians) own it.
The town's leaders knew well in advance......and the developers should have done their homework before hand.

To think that the town board, attornys, zoning, planning board knew nuthin............is nuts!!!! They were just too lazy and too greedy to re-visit the transaction.....and that includes the METROPLEX/GILLEN who is suppose to be the lead agency in rotterdam now.
